STM joins publishers in OpenAI copyright amicus brief

STM has joined with the Association of American Publishers (AAP), the Independent Book Publishers Association (IBPA), and Copyright Clearance Center (CCC) in an amicus brief supporting the plaintiffs in In Re: OpenAI, Inc., Copyright Infringement Litigation before the US District Court for the Southern District of New York.

The case brings together a number of copyright actions against OpenAI concerning the alleged unauthorised use of copyrighted works to train its AI models, as well as claims against Microsoft relating to its involvement with OpenAI. The court’s determination is expected to be the first opinion from a New York court addressing copyright and AI training.

The amicus brief supports the author, publisher, and news publisher plaintiffs, arguing that established copyright principles continue to apply when copyrighted works are used to train generative AI. It also highlights the growing market for licensing content for AI, and that fair use adapts to technological change rather than displaces copyright owners’ rights.
