EU Copyright in the Digital Single Market Article 3 Constraint
A TDM policy using the ODRL Vocabulary and Expression JSON Format can identify conditions covered under DIRECTIVE (EU) 2019/790 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL – TITLE II, Article 3 and related recitals (DSM Directive, Article 3). STM does not interpret the Article 3 conditions, and refers to the relevant provisions of the DSM Directive for TDM actors to evaluate whether their activities meet the conditions set out. The STM TDMRep recommendation considers the inclusion of this constraint in permissions a best practice. This allows publishers to clearly indicate the consideration of Article 3 TDM conditions. This constraint is achieved through an “stm” specific operand.
